After being ecstatic and over the moon about getting a hold of a CBR400 I noticed a drip of oil , thought this cant be good , any way to cut a long story short the previous owner has sold me a lemon as at some point in the past the lower fairing bracket ( behind coolant hoses ) has been damaged / snapped off and badly repaired. The weld is not good and has not sealed - thus allowing all the oil to flow oil through the hole thats left . This was stuffed with some sort of gasket compound to try and plug the leak but has obviously failed and brought it to light. There is no way I could have seen this when purchasing the bike due to its location , does any body have any idea if this can be repaired without totally stripping the engine or is it a lost cause ? :twisted:

When did you get it?

HOw was it purchased?

Did you get a receipt?

You do have legal rights...so look into them. Call the seller, tell them you want your money back...simple.

Distance Selling Directive might apply? Call the citizens advice too - depends if you want to fix it, or to get your money back?

It all depends how long ago you bought it - 2 weeks, I think, is about the limit??

Via Ebay , the bike was advertised as "mechanically sound" , it was not possible for me to view as it was a 2hr drive away . The bike was collected for me and here we are , it was only a cuople of days ago !

Can you not contact ebay then and state that it was not as advertised?

Done this today via Paypal , they have given the seller 14 days to respond , handy ! Means I have no bike and no money to buy another until its resolved , so far the seller has not replied to my emails / texts or phone calls so Iam mega chuffed as you can imagine . Lovely looking bike otherwise .

My CB400 was a similar one, although they did mention it a 'little oil leak'. That's fair enough I thought. Until a checked where it was (behind the front sprocket) instead of replacing the seal, someone thought it might be a good idea to cover the whole area in Araldite! Very handy...not.
It's off the road now until I can split the casings and replace the oil seal. :roll:

There's always a reason they're such a 'bargain'. :grin:

I hope you get your issue sorted soon.

Stick with it. you will get your money back

as per the distance selling directive> kit has to be useable for the purpose intended...

lets hope so , dont think there is much chance of getting it repaired !

Good news , been to see a specialist welder witgh the bike today and he said its an eay repair for him to carry out :grin: :grin: , I have got a hefty wedge back from the bloke I bought the bike from too !

Update >>>

Bike casing fully repaired , new sump gasket and bolts ( there were two little cherubs snapped off in the casing )fork oil seals replaced , top yolk bearing replaced ( v slightly notchy ) , new graphics to go on , oil change + filter , new battery ,brakes stripped down and cleaned , forks polished , bike has been meticulously cleaned by yours truly ,fairing top bracked stripped and resprayed , exhaust tubes sprayed black , air tubes sprayed up (just need to get rear seat fairings resprayed) , skidmarkz fairing filed to fit better ,new indicators all round , but now all ready to go apart from that so I will upload some pice when I can get it out after it stops bleeding raining !!
All in all a labour of love but :grin: well worth it !
